Either you or your spouse must have been living in Texas for at least 6 months and in the county in which you're filing for the preceding 90 days before you can file for divorce.
There are also some special exceptions for members of the military that have been stationed elsewhere.

I have lived in Austin since October and my husband still lives in Colorado. How does the court measure how long I have been in the state? I registered my car here in November but havent changed my DL yet. What do they go by? Thank you so much for your time and attention!

You can sign an affidavitA written statement sworn to under oath (either before a notary public or a County Clerk) by its signer. that states when you moved to Texas. If the date were contested by anyone, the court would likely look at evidence such as a lease, utility bills, or mail addressed to you with a postmark that would indicate when you started receiving mail here.
