Keep in mind that your spouse's lack of response won't stop you from having your divorce granted. In this situation, it's imperative that your spouse received formal notice of the Original Petition of Divorce. The safest way to insure a spouse was given official notice is by having him or her served by a sheriff's deputy, constable or private process server. Once this is accomplished and the 20 day answer period has lapsed, you can seek a default divorce judgment on the 61st day after filing for divorce.

Great post. This is a common issue on the divorce boards. Most people do not realize that they can still get a divorce when their spouse contests it. I myself did not realize this until I learned it from one of the forum members. I'm glad because otherwise I'd still be married ! I went through a document prep service, Divorce4her, and it went smoothly after that.
Thank you for posting this information, I know it will help a lot of people (women especially) who are wanting a divorce.

I did not realize this either. My wife has been fighting me on this divorce for months, I figured I just had to wait it out. Unfortunately, I did not receive the best help from the forums, no body informed me of this. I will certainly share this with others I speak to, I know it will help them as I met a lot of people in the same situation....
Also heard of those online services, a lot of people from the forums used them. Me, I went with the lawyer because the wife wouldn't sign!
