It’s true that Texas is a community property state, but that doesn’t mean that everything will be split 50/50. The Texas Family Code gives the courts the ability to make a “just and right” division of the community property. (See Chapter 7 of the Texas Family Code: Award of Marital Property) But again, a “just and right” division doesn’t necessarily mean a 50/50 split.
